Alleged Illegal Practices in Digital Fiction: Plagiarism Behind Intertextuality in Fiction

Popularitas cerita dalam bentuk Alternate Universe (AU) di platform media sosial seperti TikTok telah membuka peluang baru dalam penerbitan sastra digital. Namun, fenomena ini juga menimbulkan masalah serius terkait pelanggaran hak cipta dan praktik ekonomi ilegal, seperti plagiarisme. Penelitian ini berfokus pada kasus dugaan plagiarisme yang terjadi di TikTok, khususnya terkait dengan penarikan buku oleh penerbit Tekad.id. Buku "Bramana’s Family," yang ditulis oleh Aru, diduga merupakan hasil plagiat dari cerita AU yang awalnya ditulis oleh Nova Siswanto di akun TikTok @mencintaimantan. Artikel ini menggunakan metode kualitatif dengan pengumpulan data melalui wawancara, analisis konten, dan studi literatur terkait kasus ini. Penelitian ini menelaah secara mendalam konten karya yang diduga melanggar hak cipta untuk memahami pola-pola plagiarisme yang terjadi di ranah sastra digital. Ditemukan bahwa pengawasan hukum yang berlaku sering kali tidak cukup untuk menangani pola-pola plagiarisme yang terjadi. Pola-pola seperti kemiripan dalam titik konflik dan penokohan, tidak selalu dapat dikategorikan sebagai plagiarisme secara presisi menurut hukum. Penelitian ini menekankan perlunya langkah-langkah lain, seperti kontrak yang jelas antara penulis dan penerbit, serta pemahaman dan penegakan kode etik penerbitan sastra digital. Kasus ini juga menyoroti pentingnya peran warganet dalam mengawal penegakan kode etik, sebagaimana yang terlihat dalam kampanye melalui tagar #JusticeforNova. Hasil penelitian ini menunjukkan bahwa meskipun penegakan aturan hukum dalam sastra digital masih memiliki kelemahan, kekuatan dari komunitas digital memungkinkan adanya pengawasan dan penegakan etik yang lebih efektif. Hal ini sangat penting mengingat komunitas digital merupakan tempat di mana pembaca pertama kali berkembang.
